CALL TO ORDER / PRESENTATION OF MINUTES
- Bill Steenis called the meeting to order at 7:08pm. Present were Bill Steenis, Steve Yandl and Nicole Klages.
- Steve Yandl presented the meeting minutes of the July 2011 meeting. Vote was unanimous to accept the minutes.
- Bill Steenis pointed out that the list of members of the Architectural Control Committee needed to be updated on our web page.
TREASURER’S REPORT
- Steve Yandl provided financial status. The CD with long term capital replacement is at $76,632 and still owed the contribution from current assessments. The operational reserve is at $24,062.
- There is $64,087 in checking but several large checks that have not cleared. Actual operational funds are approximately $30k.
- The CD just renewed so we may have to incur a penalty if we opt to borrow from this fund to avoid paying interest on any legal settlement. Current fence repairs will be paid for with funds designated to go into the CD from current assessments (unanimously approved).
MAINTENANCE
- Fence panels still need to be painted. Cheryl Carlson reported prior to the meeting that she had spoken to Skinner to remind him the job needed to get done promptly.
ARCHITECTURAL CONTROL COMMITTEE / CC&R VIOLATIONS
- Several tent issues remain unresolved. Steve Yandl is seeking some support in letter writing on ACC matters.
- Letters were sent on yard maintenance and corrections made so no fines were imposed.
YARD OF MERIT
- Bill Steenis reported that quite a few members were getting awards for the first time. With few exceptions, yards in the neighborhood are looking very good.
- Steve Yandl reported that new program chairperson, Vickie Lindblad is doing a great job getting the list of award winners in time to make the appropriate newsletter issue.
OLD BUSINESS
- Bill Steenis reported on the outcome of our trial with Aaron Guimont.
- Bill had spoken with our insurance agent who said he would support us in attempting to make a claim for our costs in the Guimont case although the carrier rejected our initial claim.
- Bill reported on latest developments in the Jason Warner lawsuit. One of Warner’s attorneys was present in court the last day of the Guimont trial and we suspect they were encouraged in their dispute based on the outcome of the Guimont trial. Steve Yandl will be filing a claim with our D&O policy. Jason had contacted Steve Yandl about a possible meeting without lawyers to discuss settlement but scheduling prior to the scheduled motion hearing can’t be arranged.
- We discussed timing on any special assessment. We need to get the insurance company response first and then we can discuss the assessment plan at the September meeting.
- Bill Steenis had composed a letter to the judge in the Guimont case but had not made a final decision to send it.
