The purpose of this special meeting was to consider a request from Harischandra Dubey at 15222 67th Drive SE, Snohomish, WA 98296-8980 (Lot 1-0-036) for variance per Covenants, Conditions, Restrictions, and Easements for Sector 2A at Snohomish Cascade Association (CC&Rs) section 6.17 to rent his house which is not allowed per section CC&Rs section 6.3.

CALL TO ORDER / ROLL CALL
- Board President Matt Hale called the meeting to order at 7:05 PM.
- Board members present (Zoom conference) were Matt Hale, Steve Yandl, David Divoky, Bill Steenis, Tany Edwards, Gary Hebert, and John Alleman. This was a quorum.
- Matt emphasized that it’s important that we follow all the rules and procedures.
- John previously forwarded correspondence from Hari Dubey via email [These are attached to the minutes]. John asked if all members were in receipt of the materials, and all responded affirmatively.
- John reminded the other board members about the process for the CC&R section 6.17 process which requires a factual showing of an undue hardship based on application of the rules, in this case, CC&R section 6.3.
- David commented that the circumstances seem irrelevant and not consistent with an undue hardship.
- Bill remarked that Hari has been in the neighborhood for less than a year and should have known that cash flow would be an issue.
- Tanya commented that the commute from here to Redmond does not rationalize an undue hardship.
- Gary commuted to Redmond and Bellevue for over 10 years, but it was a choice to live in the neighborhood. There are probably other ways for Hari to address the hardship. John did state that Hari’s excessive commute was not in the materials presented to the board but was in an email [This email has been appended to the end of Hari’s request correspondence].
- Matt commented that renting the home doesn’t seem to solve the cash flow problem presented in Hari’s letter to the board. Additionally, the proposed renting solution is open ended with no resolution.
- Steve commented that a bad commute does not constitute an undue hardship.
- Gary commented that there have been many instances of more severe hardships where neighbors have been forced to move and in turn sold their home.
- Steve moved to decline the request, Matt put to a vote.
- There was a unanimous vote to decline the request.
